An officer saw a red Buick driving through a closed section of Center Street between Orange Avenue and Palmetto Avenue at 11:15 pm. The road had been closed due to construction.

 

When the officer approached the car, the driver rolled down the driver side rear window. When the officer told her she had rolled down the wrong window, she rolled down the driver's window.

 

The officer smelled the odor of an alcoholic beverage on the driver's breath. He also observed the driver's eyes were bloodshot and watery. The driver's speech was slurred.

 

When asked why she was driving down a road which had "ROAD CLOSED" signs at each end, the driver said she thought she was allowed to drive down the road.

 

The driver was given a series of field sobriety exercises which she could not successfully complete. Earnestine Griner Hines, 53, was arrested for DUI and booked into jail. At the jail, Hines refused to take an Intoxilyzer test.
