At 12:40am, officers were dispatched to an Armed Burglary which had just occurred in the 800 block of Cove Street. Upon arrival officers made contact with a male subject who stated while watching TV a male subject entered through the unlocked front door. The man had a semi-automatic gun in hand, a mask on his face, gloves on his hands, and a hoody over his head. The male demanded money from the victim and put the gun to his head. The male suspect also pointed the gun at two other victims and demanded money from them also. All three victims advised the male subject sounded like and matched the physical description of their neighbor, David Muniz. During the incident one of the victims called the suspect David and the suspect became angry, saying he was not David. The suspect discharged a round from the firearm into the bedroom ceiling, telling the victims that he was not playing and that he wanted their money. The suspect threatened the victims that he would be coming back and then left the home out the back door.

 

In the victim's home was discovered one spent Winchester .9mm-Luger semi automatic handgun casing and one .9mm-Luger semi automatic bullet. The officers also discovered evidence of a round being fired into the ceiling in one of the bedrooms. The victims stated they knew Muniz and that they use to be friends with him and his girlfriend, but the friendship ended negatively and that they have been involved in an ongoing feud with David Muniz and his girlfriend.

 

Officers made contact with Muniz at his residence. Muniz advised he had been sleeping. Muniz advised he knew nothing of the incident. Muniz is a convicted felon and should not be in possession of any firearms. A search warrant was issued for Muniz's home. Muniz and his wife both denied having any firearms in their home. Upon execution of the search warrant items were found that matched the bullets and casing at the victim's residence. During the search other items and evidence was found pointing to Muniz.

Muniz was placed under arrest for Attempted Home Invasion Robbery, Aggravated Assault with a Firearm and Possession of a Firearm/Ammunition by a convicted felon. Muniz was then booked into jail.
